Terms & Conditions

Last updated: October 2026

These terms apply when you use this website, hire us to build a website, are on our monthly website plan, or order NFC products from us. Please read them before you buy.

The short version. You pick a build plan, pay a deposit to start, and pay the balance at launch. Every site we build is on our $50/month plan, which covers hosting, your domain, security and changes. We own and host the sites we build, and you can use yours for as long as your plan is active. Your content and your domain stay yours. NFC cards are printed to order, so they can't be returned — but if one arrives damaged, faulty or wrong, tell us within 14 days and we'll replace it or refund it. We can't promise particular search rankings or sales.

1. Who we are

NextGen Websites is a website design and development business owned and operated by Markus Peach as a sole proprietorship in Kansas, United States.

By using this site or buying from us, you agree to these terms. If you don't agree with them, please don't use the site or place an order.

Website clients also sign our Client User Agreement. If you've signed one, it controls wherever it differs from this page.

2. What we do

Work is delivered to the scope we agree in writing, with the care and skill you'd expect from a professional in this field.

3. Eligibility

By hiring us or ordering from us, you confirm that you are at least 18 years old, that you can enter into this agreement (on your own behalf or for your business), and that you will use our work for lawful purposes.

4. Plans and scope

Website builds come in three plans: Starter ($300–$500, up to 5 pages), Standard ($500–$800, up to 10 pages) and Premium ($800+, unlimited pages). Your plan, price and what we're building are written into your Client User Agreement before work starts.

While your monthly plan is active, changes and updates to your site are included at no extra charge.

Launch dates are estimates. They assume you get us content, feedback and access when we ask for them, and they move back if those arrive late.

5. Your responsibilities

You agree to:

We're not responsible for delays caused by missing content, slow feedback, or details that turn out to be wrong. If a project goes 60 days without your content or feedback, the project closes and the deposit isn't refunded, since it covers work already done.

6. Payment

7. NFC product orders

8. Returns and replacements

Because each item is custom-printed or encoded for you, we can't accept returns or exchanges for change of mind.

If your order arrives damaged, defective, or isn't what you ordered, email nextgenwebsitedesign@gmail.com within 14 days of delivery with your order number and a photo. We'll replace the item or refund it, whichever you prefer. If a parcel never arrives, tell us and we'll trace it with the carrier and make it right.

9. The monthly plan

Every site we build is on our $50/month plan. It's required: it keeps your website and domain live, and because we host every site we build, sites can't be moved to another host.

10. Ownership

11. Third-party services

Websites depend on services we don't control: hosting, domain registrars, payment processors, email providers, plugins and analytics. We're not responsible for their downtime, price changes, policy changes, or data loss on their side, though we'll help you deal with any of it.

12. No guaranteed results

We build fast, well-structured sites and do honest SEO work, but nobody can guarantee search rankings, traffic, leads or sales. Those depend on your market, your competitors, your pricing and how search engines choose to rank things. Anyone who promises you otherwise is guessing.

13. Limitation of liability

To the fullest extent the law allows, we're not liable for indirect, incidental or consequential losses — including lost profits, lost data, downtime or lost business — arising from our services or this website. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law.

14. Indemnity

You agree to cover us against claims, damages and costs, including reasonable attorney fees, that come from content or materials you gave us, your use of what we built, or your breach of these terms or of the law.

15. Ending the agreement

You can end a project or your monthly plan by telling us in writing (email is fine), subject to the payment and notice terms above. We may pause or end work if these terms are broken, if an account stays unpaid, or if we're asked to do something unlawful or abusive. We'll always tell you why.

16. Governing law

These terms are governed by the laws of the State of Kansas, United States, and any dispute will be handled by the courts serving Johnson County, Kansas. If any part of these terms is found unenforceable, the rest still applies.

17. Changes to these terms

We may update these terms from time to time. The current version is always on this page with a "last updated" date. Changes don't affect a project already quoted and agreed.
